Joseph Krcmar is a litigation partner in the Chicago office of Maxson Mago & Macaulay, where his practice focuses on complex litigation and counseling clients on related issues, including commercial contractual disputes, construction and real estate law, and related regulatory issues. Mr. Krcmar also has experience in elaborate bankruptcy and financial services litigation disputes.

Prior to joining EM³, Mr. Krcmar was a partner in the Chicago office of a prominent national firm. Mr. Krcmar also previously worked in-house at one of the most respected Fortune 25 companies in the world, serving in the Commercial Litigation and Class Action Department, as well as managing an assortment of class action claims, business operations, transactional, contracts, as well as compliance issues. Mr. Krcmar also served as a judicial law clerk for the Honorable Susan Pierson Sonderby of U.S. Bankruptcy Court, Northern District of Illinois.

Mr. Krcmar received his Juris Doctor from the University of Illinois College of Law, Champaign, Illinois in 2009, where he served as the managing editor of the Illinois Business Law Journal. In 2004, Mr. Krcmar graduated with a Bachelor of Arts degree from Butler University, Indianapolis, Indiana, and as a student athlete.

Represented a top Fortune 500 Company in a multi-state litigation, mediation and settlement of construction contract dispute against a nation-wide general contractor and 30 plus individual subcontractor claims.

Defended a national self-storage company in the Northern District of Illinois Bankruptcy Court regarding, among other claims, allegations of a willful violation of the automatic stay. Successfully obtained a dismissal with prejudice of the action on a motion to dismiss.

Represented Fortune 500 Company regarding violations of the Fair Debt Collection Practices Act (FDCPA) and Telephone Consumer Protection Act (TCPA). Successfully recouping attorneys from collection agency through contractual indemnification.

Successfully obtained variance to city ordinance on behalf of a big box retailer, presenting in front of multiple municipal committees and public forums.

Represented nation-wide company in the Northern District of Illinois regarding breach of contract claims and violations of the Fair Credit Billing Act and Fair Credit Reporting Act. Negotiating a global settlement between multiple Fortune 500 Companies.

Represented global corporation in a variety of disability discrimination claims under the Americans with Disabilities Act regarding alleged violations of the Standards for Accessible Design.

Represented medical professional in malpractice action regarding cosmetic surgery. Successfully obtained a dismissal with prejudice of the action on a motion to dismiss.

Represented a financial institution against a core adversary proceeding for an alleged violation of a discharge injunction in the Northern District of Illinois Bankruptcy Court. Successfully obtained a dismissal with prejudice on a motion to dismiss.
